Terms of Service

1. Service Description

AgentErgon provides an AI agent platform that enables businesses to deploy automated customer interaction agents across chat, SMS, and hosted page channels. The service includes agent creation, deployment, conversation management, and analytics.

2. Account Registration

You must provide a valid email address to create an account. You are responsible for maintaining the security of your API key and account credentials. You must notify us immediately of any unauthorized access.

3. Billing and Payment

Paid plans are billed monthly via Stripe. Prices are listed at agentergon.com/#pricing. Conversations exceeding your plan's included amount are billed at the overage rate for your plan. Your agent is never interrupted due to overage — overages are billed on your next invoice. You may set a spending cap in your dashboard to limit maximum monthly charges.

4. Data Ownership

Your data is yours. You retain full ownership of your business data, knowledge base content, and conversation transcripts. We do not claim any intellectual property rights over your content. You grant us a limited license to process your data solely for the purpose of providing the service.

5. AI-Generated Content

Responses generated by your AI agent are produced by third-party AI models (Claude by Anthropic). While we design agents to be accurate and helpful, AI-generated responses may occasionally be incorrect. You are responsible for reviewing agent performance and maintaining an accurate knowledge base. We recommend enabling human handoff for high-stakes conversations.

6. Acceptable Use

You may not use AgentErgon to:

  • Generate spam, phishing, or fraudulent communications
  • Impersonate individuals or misrepresent your business identity
  • Process or store sensitive personal data (SSN, health records, financial account numbers) through agent conversations
  • Violate any applicable laws, including AI disclosure requirements

7. AI Disclosure Compliance

AgentErgon agents include built-in AI disclosure. You are additionally responsible for ensuring your use of AI agents complies with all applicable federal, state, and local laws, including but not limited to California SB 243, Colorado AI Act, and Washington HB 2225.

8. Service Availability

We target 99.9% uptime for the agent platform. We do not guarantee uninterrupted service. Scheduled maintenance will be communicated via email. We are not liable for downtime caused by third-party providers (Anthropic, Twilio, Stripe).

9. Cancellation

You may cancel your subscription at any time from your dashboard or by emailing hello@agentergon.com. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

10. Limitation of Liability

AgentErgon is provided "as is." We are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to lost revenue from agent errors, missed conversations due to outages, or inaccurate AI responses. Our total liability is limited to the fees you paid in the 12 months preceding the claim.
